    Bringing Home the Criminal Justice System: Expert Group to Lead

    Greenland Takes Steps to Reclaim its Criminal Justice System

    In a significant move towards self-determination, Naalakkersuisut has initiated the process of reclaiming control over Greenland’s criminal justice system. This decision, backed by broad political support, was announced by the Department for Children, Young People, the Justice Area, and Equality.

    “We must ensure that our legislation and societal responses to crime reflect the values and customs distinctive to our country and address the unique needs of our social landscape,” stated Mariane Paviasen Jensen, the Naalakkersuisut member responsible for justice.

    As a crucial first step, an expert group has been assembled to lay the groundwork for this transition. This group will assess how current criminal legislation can be modernized and tailored to better fit the realities of life in Greenland. Simultaneously, Naalakkersuisut will begin formal negotiations with the Danish government concerning a transfer agreement.

    Currently, the Danish Parliament holds the authority to legislate on punitive measures, with police forces, courts, and corrections—including prisons—operating under Danish jurisdiction.

    A Push for Stricter Sanctions

    Naalakkersuisut is also looking to reform how sanctions are assessed by courts. Presently, judges have considerable discretion to determine appropriate penalties based on the crime’s severity and the perpetrator’s circumstances. However, the government is considering implementing a structured framework dictating minimum sanctions for specific crimes, particularly those posing serious threats to individuals, such as sexual offenses and crimes against children.

    This initiative reflects a growing national conversation surrounding penal reforms and the parameters within which penalties are assessed.

    Tailoring Legislation to Greenlandic Realities

    In her remarks, Jensen emphasized that the repatriation of the criminal justice system must lead to more contemporary and comprehensible legislation. She articulated a vision for a justice system that resonates more closely with the Greenlandic populace’s sense of justice.

    The repatriation aims to allow Greenland to continually evolve its legal framework, thereby enhancing legal certainty and fortifying public trust in the judiciary.

    As for when the expert group will conclude its work, the press release leaves that detail uncertain, but the anticipated changes mark a pivotal chapter in Greenland’s journey toward greater autonomy.
